These general terms and conditions of sale (hereinafter also referred to as the “Terms and Conditions of Sale”) govern the online purchase of products through the website https://www.turtlesup.com/ (hereinafter also referred to as the “Site” or the “online store”).
The products purchased on https://www.turtlesup.com/ are sold directly by Sunnyside S.r.l. (hereinafter also referred to as the “Seller”), a company governed by Italian law, with registered office in Genoa, Via Corsica 2, registered in the Genoa Business Register under number GE-521676, with a share capital of €12,000, VAT No. 0294100997, Tax Code 0294100997.
1.1 The Seller offers the products for sale on https://www.turtlesup.com/ and conducts e-commerce activities both for “consumer” customers (B2C) and “professional” customers (B2B).
1.2 A “Consumer” is defined as a natural person purchasing one or more products through the online store for purposes not related to any business, commercial, artisanal or professional activity.
1.3 A “Professional” is defined as a natural or legal person purchasing one or more products through the online store in the course of their business, commercial, artisanal, or professional activity.
1.4 These Terms and Conditions of Sale regulate the offer, submission, and acceptance of orders between customers of https://www.turtlesup.com/ and the Seller. Where specified, these Terms and Conditions apply exclusively to Consumer Customers and not to Professional Customers.
1.5 The Seller reserves the right not to process orders that are not properly completed in accordance with these Terms and Conditions of Sale.
2.1 To purchase one or more products on the Site, you must fill out the electronic order form and submit it electronically to the Seller, following the instructions provided.
2.2 The order form includes a summary of the essential features of each ordered product, its price (including all applicable taxes), available payment methods, delivery methods and costs, the conditions for exercising your right of withdrawal, and the return methods and timelines.
2.3 The contract is deemed concluded when the Seller receives the order form electronically, after verifying the accuracy of the data provided.
2.4 Before proceeding with your purchase, you will be asked to carefully read these Terms and Conditions of Sale.
2.5 The order form will be stored in our database for the time necessary to process the orders and within the legal limits. You may access your order form through your account on the Site.
2.6 The Seller may not process your order in case of non-receipt of payment via bank transfer or Nexi, or if the order is incomplete or incorrect, or if the products are no longer available. If the products are no longer available or on sale at the time you access the Site or send your order, the Seller will notify you within thirty (30) days from the day following the order submission. In case of payment already made, the Seller will refund the amount paid.
2.7 By submitting the order form electronically, you unconditionally accept and agree to abide by these Terms and Conditions of Sale. If you do not agree with any of the terms, please do not submit the order form.
2.8 By submitting the order form, you confirm that you are aware of and accept the Terms and Conditions of Sale, as well as the additional information on the Site, including the Privacy Policy and, if you are a Consumer, the Notice of Right of Withdrawal.
2.9 Upon conclusion of the contract, the Seller will send you an order confirmation via email, including a summary of the information already contained in the order form.
You may view your order confirmation in your account on the Site.
3.1 The essential characteristics of the products are presented on the Site on each product page. However, the images and colors may differ from the actual product due to the browser or monitor used.
3.2 The Seller does not sell used, irregular, or substandard products.
3.3 In case of withdrawal, the Seller may reject returned products that have been altered or damaged.
3.4 Product prices may change. Always check the final price before submitting the order form.
3.6 Products are shipped within ten (10) working days from the payment date via express courier (delivery within 24-72 hours from shipment). The Seller is not responsible for courier failures (e.g., delays or damage during transport). To lodge a complaint, you must accept delivery with a reservation of control, specifying the reason. Therefore, please sign the delivery slip with a reservation and keep proof of it.
4.1 The final price includes VAT, packaging, and shipping.
4.2 You must follow the payment instructions provided in the order form.
4.3 If paying via Nexi (credit card) or bank transfer, financial data will be processed by Nexi or the Seller’s bank. Third parties cannot access this data. The Seller uses this information only to complete the purchase, issue refunds, or report fraud to the authorities.
4.4 If paying via Nexi, the order amount will be charged immediately. For bank transfers, the Seller will provide the account details for payment.
5.1 If you are a Consumer, you may withdraw from the contract without penalty and without giving any reason within fourteen (14) working days from receiving the products.
5.2 To withdraw, you must specify the purchased products, the order number, your identifying details, and your bank or Nexi account information for the refund. You must return the products to the Seller, who must receive them within fourteen (14) working days from receipt.
5.3 Shipping fees paid to receive the products will not be refunded. However, return shipping is free if you use the Seller’s courier. If you use a different courier, return shipping costs are your responsibility.
5.4 The right of withdrawal is subject to the following conditions:
5.5 If the withdrawal is exercised according to these conditions, the Seller will refund the full purchase price within fourteen (14) days of becoming aware of your withdrawal.
5.6 If the return conditions are not met, you will not receive a refund. However, you may retrieve the products at your own expense. Otherwise, the Seller may retain both the products and the payment.
5.7 The right of withdrawal does not apply to customized or made-to-order products, pursuant to Art. 59, paragraph 1 letter c) of Legislative Decree 206/2005 (Consumer Code). Customized products include any item with custom graphic markings or made according to the customer’s specifications.
5.8 Professional Customers do not have a right of withdrawal, whether for neutral or customized products, as these contracts fall under B2B. Any cancellations must be expressly accepted by the Seller and will not be allowed if production has already started. The Customer’s order is irrevocable under Art. 1329 of the Civil Code for seven (7) working days from receipt.
After the return of products, the Seller will verify that they comply with the specified conditions.
If the checks are successful, the Seller will send you a confirmation email of the returned product acceptance.
These Terms and Conditions of Sale are governed by Italian law and, for Consumer Customers only, also by Legislative Decree no. 206 of September 6, 2005 (Consumer Code), and Legislative Decree no. 70 of April 9, 2003, on certain aspects of e-commerce.
For disputes arising from sales contracts through the Site, if the Customer is a Consumer, the competent court is the court of the Customer’s place of residence or domicile. In all other cases, jurisdiction lies exclusively with the Court of Genoa.
These Terms and Conditions of Sale may be modified from time to time in accordance with legislative changes. The new Terms and Conditions will be effective upon publication on the Site.
